Privacy
Council believes that the responsible handling of personal information is a key aspect of democratic governance and is strongly committed to protecting an individual's right to privacy. Accordingly, Council is committed to full compliance with its obligations under the Privacy and Data Protection Act 2014 (Vic) (Act). In particular, Council will comply with the Information Privacy Principles contained in the Act.

Personal information
This policy applies to personal information held by Council. Personal information means information or an opinion about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion, other than certain health or generally available information. For example, Council holds personal information on its ratepayers (eg names and addresses) in order to carry out its functions (eg planning, valuation and property services). It may also request personal information in order to provide education, welfare and other community services (eg child care services). In some instances, personal information may be contained on a public register (register of building permits, food premises and animal registration details).
Sensitive information
Council may also hold sensitive information. Sensitive information includes information or an opinion about an individual’s racial or ethnic origin, political opinions, trade union membership, philosophical or religious beliefs, sexual preferences or criminal record.
Collection
Council will only collect personal information that is necessary for its functions and activities. In some instances, Council is required by law to collect personal information. Council will only collect sensitive information where a person has consented or as permitted under the Act. If it is reasonable and practicable to do so, Council will collect personal information about a person directly from that person. When doing so, it will inform persons of the matters set out in the Act, including the purpose/s for which the information is collected, and will use lawful and fair means. If Council collects personal informational about a person from someone else, it will take reasonable steps to make you aware of these matters.
Use and disclosure
Council will only use personal information within Council, or disclose it outside Council, for the purpose for which it was collected or in accordance with the Act (eg where you have consented or where you would reasonably expect this to occur).
Security
Council will endeavour to maintain a secure system for storing personal information. Technological and operational policies and procedures are in place to protect personal information from misuse and loss and from unauthorised modification or disclosure. Council will dispose of personal information where it is no longer necessary to fulfil the purposes for which the information was collected or as required by law.
Access and correction
People can access their personal information by contacting Council's Privacy Officer. Access will be provided except in the circumstances outlined in the Act, for example, where the information relates to legal proceedings or where the Freedom of Information Act 1982 applies. If people think that their personal information is inaccurate, incomplete or out of date, they may request Council to correct the information. Each request will be dealt with in accordance with the Act.
Anonymity
Where lawful and practicable, Council will give people the option of not identifying themselves when supplying information or entering into transactions with it.
External contractors
While personal information is usually handled by Council staff, Council may outsource some of its functions to third parties. This may require the contractor to collect, use or disclose certain personal information (eg garbage collection). It is Council’s intention to require contractors to comply with the Act in all respects.
Complaints
If you a person feels aggrieved by Council's handling of personal information, they may make a complaint to Council’s Privacy Officer. The complaint will be investigated as soon as possible (but no later than 10 business days) and the person will be provided with a written response. Alternatively, people may make a complaint to the Privacy Commissioner (although the Commissioner may decline to hear the complaint if they have not first made a complaint to Council).

Freedom of Information Act 1982 Moyne Shire Council is collecting your information for the purposes of processing your Freedom of Information application under the Freedom of Information (FOI) Act 1982 (Vic). We require this information from you for the use of the Freedom of Information Officer to be able to communicate with you about your FOI application. The FOI officer may share your information with Moyne Shire Council’s Principal Officer, other FOI decision makers and our accounts area.

Arts and Culture Advisory Group - expression of interest for members
Moyne Shire Council (Council[s]) is committed to protecting your privacy and is providing this opportunity to express interest in membership of Council’s Arts and Culture Advisory Group.
Your contribution will assist with the implementation of Council’s Arts and Culture Strategy.
Council seeks to support policies, programs and services (projects) that are responsive to gender, biology/environment, location, and diversity.
In this setting, the collection of any demographic information allows for grouping and analysing responses by demography and location of participants. This enables the promotion of gender equality; a main purpose under the Gender Equality Act 2020 (Vic) and aligns with the objects and principles. This information is optional to provide.

Moyne Shire Council youth engagement program privacy collection notice
Your personal information will be collected during the youth engagement expression of interest process for the purpose of reviewing your eligibility. Moyne Shire Council is required to collect this information for grant applications to Department of Family Fairness and Housing (DFFH). Our main sources of funding streams include FReeZA and Engage. Program guidelines require us to report on how many people we engage, demography and location, we do not name people when reporting to DFFH. By providing sensitive information, you are taken to have consented to its collection.
Part of the grant application criteria requires that the grant application outlines the strategies the project will use so the FReeZA and Engage committees and events are inclusive and accessible to all young people. This includes those identifying as LGBTIQA+, multicultural and multifaith young people including from newly arrived and refugee communities, Aboriginal young people and young people living with disability. Collection of this information from you is defined as sensitive information under the Privacy and Data Protection Act 2014 (Vic).
Youth engagement program
Your expression of interest information will be used to determine your eligibility for the program. Council is committed to protecting the privacy, confidentiality and security of personal and sensitive information in accordance with the Privacy and Data Protection Act 2014 (Vic). If the information is not collected, we will not be able to contact you with more information about the program you have inquired about.
While the youth engagement program expression of interest process is underway
The application will be assessed for eligibility. The information may be shared with the Warrnambool City Council Youth Team as part of the combined Moyne and Warrnambool Youth Strategy available here Moyne and Warrnambool Youth Strategy 2025 – 2030. The program officer (assessor) may share your information with Moyne Shire Council broader Cultural and Community Development staff to assist with assessing applications. It will not be disclosed to any other external party without your consent, unless required or authorised by law.
Council meetings
Youth engagement program expression of interest may be discussed at Council. If so, Ordinary Council Meeting agendas are made publicly available on Moyne Shire Council website. Successful youth engagement program applicants may be announced at Ordinary Council Meetings, published in the agenda and minutes. Ordinary Council Meetings are also live streamed on social media. All personal and sensitive information including contact details will be removed from published documents. This information will be redacted for privacy and only your name would be used.

Moyne Shire Council scholarship program privacy collection statement
Your personal information will be collected during the scholarship program application and assessment process for the purpose of reviewing your eligibility of the application. Moyne Shire Council will be advised of your application and communicated to throughout the submission and assessment process. Moyne Shire Council is required to collect this information for financial management and reporting requirements under the Local Government Act 2020.
Scholarship application

All applications will be treated as public documents in so far as the applicant name may be made public. No referee names, application information or submitted content will be published.
