Nullawarre Hall conditions of use

Nullawarre Hall is made available by Moyne Shire Council as part of the Creative Residency Program, which supports creative development by providing temporary access to suitable spaces across the Shire.

Use of the hall under this program is subject to the following conditions.

Application and approval

The right to use the hall is subject to Council receiving a booking request through the Creative Residency Program application process.

Bookings are not confirmed until approved by Council and all required documentation, including evidence of Public Liability Insurance, has been provided.

Access arrangements will be confirmed once the booking has been approved.

Use of the Hall

The hall may only be used for the creative activities outlined in the approved application.

The hall must not be used for:

  • Residential or overnight accommodation
  • Commercial trading or ticketed events without prior written approval
  • Sub-letting or transferring access to another person or organisation
  • Any unlawful purpose

Residents must ensure their activities do not damage the premises or interfere with the reasonable use of the facility by others.

Access and keys

Access arrangements will be confirmed prior to commencement.

Residents must ensure the premises are secured when leaving.

  • Keys must be collected and returned as directed.
  • Lost or unreturned keys may incur replacement costs.

Council reserves the right to access the premises during the hire period for inspection, maintenance or operational purposes.

Safety and compliance

The resident must comply with all relevant legislation, including health and safety requirements.

Exits and accessways must remain clear at all times.

Hazardous materials or high-risk processes must not be undertaken without prior written approval from Council.

Council reserves the right to cease any activity considered unsafe or inappropriate.

Insurance

Residents must hold current Public Liability Insurance with a minimum cover of $20 million for the duration of the booking.

Evidence of insurance must be provided prior to use of the Hall.

Residents are responsible for the insurance of their own artworks, materials and equipment.

Cleanliness and condition

Residents are expected to maintain the Hall in a clean, safe and respectful condition throughout the booking period.

All rubbish, materials and equipment must be removed at the conclusion of the booking.

The resident must not:

  • Make structural alterations
  • Install fixtures or attachments without prior written approval
  • Damage floors, walls, fittings or furniture


The resident accepts financial responsibility for damage beyond normal wear and tear.

Council may recover reasonable cleaning or repair costs where required.

Waste disposal

Residents are responsible for the removal and appropriate disposal of all materials, waste and equipment associated with their activities.

Council waste facilities must not be used for the disposal of large quantities of materials or specialised waste generated through creative activities.

Damage and property

Residents must take reasonable care of Council facilities, fixtures and equipment.

Council accepts no responsibility for loss, theft or damage to personal property brought into the premises.

Noise and consideration of others

Residents must ensure activities do not create unreasonable noise or disturbance to surrounding properties or other users of the facility.

Council may request activities to cease if they are considered disruptive or inconsistent with the approved use of the Hall.

Indemnity

The resident agrees to indemnify and hold harmless Moyne Shire Council, its employees and agents from any claim arising from the hirer’s use of the premises, except where caused by Council negligence.

Signage and alterations

No signage, decorations, fittings or other items may be attached to walls, floors, fixtures or fittings without prior written approval from Council.

Smoking

Smoking is not permitted inside the Hall.

Compliance with laws

Residents must comply with all relevant legislation, including the Local Government Act, health regulations and any applicable Council local laws.

Cancellation or termination

Cancellations must be provided in writing.

Council reserves the right to cancel or terminate a booking where operational, safety or community requirements arise, including where the space is required for Council or community use.

Where possible, reasonable notice will be provided.
