Creative Residencies Program Conditions of Use

About the Program

Creative Residencies are delivered as a pilot initiative by Moyne Shire Council, providing temporary access to selected Council-owned spaces for creative practice.

Residencies are approved for a defined period and purpose, as outlined in each successful application.

Approved Use of the Space

The space may only be used for the purpose outlined in the approved residency.

The space must not be used for:

  • Residential or overnight accommodation
  •  Subletting or transferring the space to another person
  • Commercial trading or public events without prior approval
  • Any unlawful purpose

Residents must ensure their activities align with the approved use at all times.

Access, Keys and Security

Access arrangements will be confirmed prior to the residency commencement.

Residents are responsible for:

  • Collecting and returning keys or access devices as directed
  • Ensuring the space is secure when not in use
  • Reporting any faults, damage or security concerns

Lost or unreturned keys may incur replacement costs.

Council reserves the right to access the space during the residency period for inspection, maintenance or operational purposes.

Care and Condition of the Space

Residents are expected to maintain the space in a clean, safe and respectful condition throughout the residency.

At the end of the residency, the space must be returned to its original condition, including:

  • Removal of all materials, equipment and waste
  • Cleaning of the space
  • Any damage caused during the residency must be reported and may be repaired at the resident’s expense.
  • No alterations to the space are permitted without prior written approval from Council.

Safety and High-Risk Activities

Residents must comply with all relevant health and safety requirements.

The following activities are not permitted without prior written approval:

  • Use of hazardous materials
  • Spray painting, welding or open flame use
  • Any activity considered high-risk

Council reserves the right to cease any activity deemed unsafe.

Insurance and Personal Property

Residents are responsible for their own materials, equipment and personal property.

Council does not accept responsibility for loss, theft or damage to personal items.

Residents must hold current Public Liability Insurance with a minimum cover of twenty million dollars ($20,000,000) for the duration of the residency period. 

Ending the Residency

Council reserves the right to terminate a residency if:

  • Conditions of use are breached
  •  The space is required for operational purposes
  • Safety concerns arise

Residents may also end their residency early by providing notice to Council 

At the end of the residency, all access must cease and the space must be returned in accordance with these conditions.

General Conditions

Residents must:

  • Comply with all relevant laws, regulations and Council policies
  • Not assign, transfer or sublicense the residency to another party
  • Not smoke or vape within Council buildings
