Terms & Conditions – Moyne Shire Council Business Adaptation Program.

By applying for Moyne Shire Council Business Adaptation Service (BAS), you agree to the following terms and conditions:

  1. BAS is being co-funded by Regional Development Victoria, 707-709 Raglan Parade, Warrnambool VIC 3280 and the Moyne Shire Council, Princes Street, Port fairy VIC 3284. The BAS (valued at $1000 excl GST) is free of charge to an eligible applicant.
  2. Application for BAS will be open on Monday 14th September 2020 until Friday 30th October 2020 or when the number of consultations funded by the Council is exhausted, whichever first occurs.


  1. BAS is open to businesses owned and operated by applicants:
  1. that have been impacted by COVID-19, and
  2. have an active ABN; and
  • operate a business located within the Moyne Shire Council; and
  1. have access to either phone or video technology for a conference call; and 
  2. agree to complete a short survey in late- 2020.


  1. To be eligible for BAS, you must complete the Moyne Shire Council Business Adaptation Service application form at www.moyne.vic.gov.au/????. The Council will consider each applicant for BAS on its merits. The Council’s decision is final.
  2. Eligible applicants will receive the service providers and the services they can offer free of charge. Eligible applicants are eligible to access services from only one service provider in a chosen discipline. Eligible applicants agree to bear the additional costs of those services. Should an applicant require access to services from a service provider in another related discipline, the request to do so must be through a separate application made to the Council.
  3. The Council reserves the right, at any time, to verify the validity of applicants and to disqualify any applicant from BAS who tampers with the application process or who submits an application that is not in accordance with these Terms and Conditions. Failure by the Council to enforce any of its rights at any stage does not constitute a waiver of those rights.
  4. The use of any automated entry software or any other mechanical or electronic means that allows an applicant to automatically apply for BAS repeatedly is prohibited and will render all applications submitted by that applicant invalid.
  5. BAS is not transferable or redeemable for cash.
  6. You agree that the Council (including its officers, employees and agents) is not liable (including in negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out from the provision of BAS, including, but not limited to, the following:
  1. the fitness for purpose of the service provider’s services to your business’ circumstances;
  2. the ability of the service provider to provide professional and workmanlike services to you;
  • any defective or negligent advice that the service provider provides to you.


  1. Privacy notice: The Council collects the personal information in your application for the purpose of offering BAS to you and your business during the COVID-19 crisis. This information is collected and handled in accordance with the Council’s Privacy Policy, which is available from moyne.vic.gov.au and Customer Service Centres.
